National Register Landowner Consent Bill Sponsored by Rep. Lewis Signed into Law

Primary sponsors of House Bill HB19-1078 were Rep. Kimmi Lewis, House District 64, Senate President Leroy Garcia, Senate Dist. 3, and Senator Vicki Marble, Senate Dist. 23.

The bill was introduced January 11, 2019, assigned to the Energy & Environment Committee. Energy & Environment heard testimony on February 11, 2019. The bill states: “Prior to taking any action to approve a multiple property documentation form (MPDF) or to request the approval of the keeper of the National Register of an executed form, the bill requires the state historical society to require the applicant to obtain the consent, evidenced by a signature, of each owner of the land and property included within the region of lands described in the form who provided any information or granted access to their land or property.”

The purpose of this legislation is to ensure that each private property owner within the land described of a multiple property documentation form are properly notified and consent given prior to the filing of the MPDF with the Keeper of the National Register of Historic Places. This is to ensure that no property is nominated to the National Register without owner notification and consent.

The House of Representatives passed HB19-1078 on February 22, 2019, introduced in the Senate on February 25th, passed the Senate March 20th, and signed into law by Gov. Polis, April 12, 2019.
